For example, an adult who is disabled may be able to receive income from social security. Social security is government sponsored insurance that is available to people who meet specific criteria in regards to age, disability, poverty, and unemployment.</p>
<p>However, you may be wondering if children can receive disability benefits from social security. The answer to that question can be tricky. For example, an adult may be able to receive social security for disability if he or she can prove that the disability prevents him or her from performing the labor that would be necessary to find gainful employment where that person lives. Children, however, don’t usually work. In a lot of case, they can’t even be legally employed. So this may leave some confusion over what kind of criteria would be used in a case involving a disabled child.</p>
<p>This is answered by the fact that cases over children’s disability claims have been won when it was proven in that case that the child was not able to function normally when attempting to perform activities that are relevant to children of that age.</p>
<p>Of course, one of the most important of these activities is school. If it can be proven that the child cannot function in a regular classroom, this benchmark for receiving disability benefits may be met.</p>
<p>Evidence supporting this fact will have to be gathered to make the case for how debilitating the child’s disability is in regards to school performance. A disability lawyer will probably want to track down things like report cards, records of the student’s involvement in individualized education programs, intelligence quotient tests, and achievement tests. Also likely to be needed are surveys and interviews with the student’s teachers. These are likely to give good insight into the child’s situation.</p>
<p>Unfortunately, obtaining these kinds of records and information isn’t exactly easy. This is likely to make a child’s disability claims case more difficult than a case involving an adult. There is also the possibility that childhood disabilities can be grown out of. One common example is asthma.</p>

<p><strong>Hit and Run Crimes</strong></p>
<p>A hit and run violation only worsens the sentence a perpetrator is given for committing a crime. In many jurisdictions, drivers are obligated to identify themselves and exchange pertinent information, including insurance details, when they get into an automobile accident with another driver or with a pedestrian. Usually, state laws require the driver to pull over as soon as they can do so safely. In the past, these schemes were generally referred to as workman’s compensation but this has since changed to workers’ compensation so as to make it sound neutral as pertains to gender.</p>
<p><strong>Work Injuries and Medical Care</strong></p>
<p>Therefore, quite a number of employees who sustain injuries at their work place have the right to claim medical care. In many cases, employees are given monetary payments for temporary and permanent injuries that result from injuries sustained at work. However, it is recommended that employers should enroll for workers’ compensation failure of which one may get penalties. Several states have public uninsured employer funds which enable employees working for companies that do not purchase insurance to get benefits. What is more, there are quite a number of insurance policies that employers can choose from through commercial insurance companies. Still, employers can also get insurance coverage from an assigned-risk program in cases when the company is believed to be of a great risk such that it can not be insured at a market rates.</p>
<p>Every state has its own way of overseeing workers’ compensation. Furthermore, every state also has a governing board that oversees the various public and private grouping of the systems of workers’ compensation. The federal government on the other hand also has it own program for workers’ compensation. This is governed by the federal requirement as well as statutory factor in relation to federal employees. However, workers’ compensation in most states is usually provided by private insurance companies. About 12 states have insurers operating on the state fund while quite a few are owned by the state as monopolies. Private insurers are usually protected from overcrowding by state funded insurers. Thus, state funded insurers are normally required to act as assigned-risk programs. The California’s state Compensation Insurance fund is considered the largest insurer.</p>
<p><strong>Termination of Injured Employee</strong></p>
<p>In several states it is unlawful to terminate an employee or to deny an individual employment because he/she has reported an injury sustained at work. The challenging issue is that proving discrimination using an employee’s claims history may be quite difficult. It is for this reason that most states have come up with subsequent injury trust funds that pay insurers for the benefits that they pay to workers who have suffered a compensable injury that this recurrent. Recommendation has been made to remove claims history in database or to make them anonymous.</p>
<p>Even though it is not common for employees to claim for false benefits, there are instances when recorded videos show an employee carrying out a strenuous physical activity or sport even though the employee may have claimed that he/she suffered an injury or disability. Such videos by private investigators are however not allowed in trial especially if they recording violated the employee’s privacy.</p>
<p>On the other hand, other employees aggressively contest for payment under the workers’ compensation. Such cases, especially ones entailing severe injury require counsel of an experienced lawyer conversant with workers’ compensation claims. However, many states have enacted laws that hinder the claimant from spending a certain amount of money for legal purposes.</p>
<p>Several states have however transferred disputes of workers’ compensation from the trial courts and taken them to special administrative agencies. Further still, organizations such as ABA, IAIBC and NAWCJ are striving to educate and guide workers’ compensation administrators and adjudicators.</p>

<p>In most developed countries in the world, schools are under strict codes to provide a safe environment for children and staff. Personal injury rules will vary from state to state and country to country, but the basics tend to be the same. For your own area you would need to research the finer details if you ever needed to make a personal injury claim.</p>
<p>There has been rising concern about the costs some schools have had to pay out in personal injury claims in the UK over recent years. <p>In some areas there is sometimes a fine line between where the school’s responsibility for students ends and where parent responsibility takes over. School crossings and children’s safety before and after school can become personal injury issues.</p>
<p>Many personal injuries can occur to children through things like doors slamming or being shut on fingers, slipping on wet floors or equipment left out such as guillotines for paper cutting. Some of these are obviously the schools responsibility and some are beyond their control.</p>

			<content:encoded><![CDATA[<p>Most people will never set foot in a courtroom as a result of the distribution of someone&#8217;s estate. As such, the term &#8220;probate litigation&#8221; is likely foreign to most people in our society. In fact, the term &#8220;probate&#8221; itself may be unfamiliar to many.</p>
<p><strong>What is Probate?</strong></p>
<p>Probate is when someone dies and their estate is distributed through the probate court system. People can die leaving their estates in several ways. A person can die with a will, known as dying testate. When a person has a will, the will is entered into probate with the probate court, which is a special court through which the provisions of the will are carried out, including distribution of assets as set forth in the will. When a person dies without a will, he dies intestate. The probate court then appoints an administrator of the estate and the assets of the deceased are distributed through intestate succession. Intestate succession means that those related by blood to the person (along with the spouse, if there is one) will inherit the assets of the estate. Certain assets, such as life insurance proceeds or trust assets, are not entered into or are a part of probate proceedings.</p>
<p><strong>What is Probate Litigation?</strong></p>
<p>Typically, when assets are distributed via either a will or intestate succession, the parties are agreeable with the terms and do not dispute it. However, sometimes an heir or someone who feels they should have received an inheritance will dispute the will provisions or even some aspect of inheritance through intestate succession. When that happens, probate litigation results. Probate litigation takes place when such a dispute arises resulting in a claim made to the probate court and the issue is resolved through the court system.</p>
<p>The most common situation where probate litigation arises is when a child or other close relative has been left out of one&#8217;s will. That person will likely argue that it was either the result of a mistake, or undue influence on the part of someone else, such as the widow or other children of the deceased. Undue influence means that someone had some sort of control over the testator and caused the testator to change his or her will in favor of that person. Other times there may be a claim that a different, more favorable will exists that is the valid will, or a claim that the will entered into probate is not valid.</p>

The international drug trade is an elaborate enterprise that consists of several stages. These include tending the primary producers which are mainly plants, value addition, distribution and finally sale on the streets.</p>
<p><strong>What Makes Drugs Illegal</strong><br />
It is important to note that most substances classified as drugs are not entirely illegal. As a matter of fact, they contribute to the national economy under license. They are intended for use under controlled conditions e.g. surgery or for pain alleviation. Drug operations have very discreet methods of conducting business. Not even attorneys representing them have full insight to the whole organization. Cartels are usually in charge of the various stages of the distribution network. The structure and size of these cartels depend to a large extent on the particular mandate it is charged with. They include the street peddlers, middle men and the dons or patriarchs who usually head a drug trading family that might control a drug bourse running into billions of dollars. According to a U.N report, the international drug trade represents 0.9% of the entire global commerce.</p>
<p>Drugs are grown in the most discreet of places. The farms might be indoors, on top of buildings or in protected areas e.g. national parks. Value addition or processing is also a top secret affair mainly taking place in heavily fortified or isolated buildings. The global market for narcotics is vast and in most instances ready to pay any amount for a constant supply of the same. This means that irrespective of the big amounts of money involved in concealing narcotics from law enforcers, once they get into the target market, they still rake in obscene profits.</p>
<p>Attorneys are quick to point out that not all drugs trade classified as illegal involves narcotics. Legal drugs e.g. cigarettes and alcohol that have not had duty paid for them are also part of this clandestine trade. These are very hard to unearth as they normally follow a legal route in the initial stages before diversion. The prescription model in most countries acts as a kind of restriction to the proliferation of various drugs.</p>
<p><strong>The War against Drug Usage</strong><br />
The war against narcotics is a very complicated affair considering that demand for these narcotics is not showing signs of reducing anytime soon. Before anything else, you can start off by doing some research to help you understand the basics of owning a property. Here is a quick overview:</p>
<p><strong>What is Property Ownership?</strong></p>
<p>Once a person or a group of people own a property, they have the right to sell, rent, consume, mortgage, transfer, exchange, and destroy this property at their own discretion.</p>
<p><strong>What are the Forms of Property Ownership?</strong></p>
<p>Here are some common ways of owning a property:</p>
<ol>
<li>Sole Property Ownership – this refers to a property owned entirely by one person without any other owners. When you die, property owned in your name can be distributed to your beneficiaries in your will, as long as you recognize your spouse&#8217;s marital interest.</li>
<li>Tenancy in Common (TIC or T/C) – this refers to a property owned by two or more persons at the same time. Each person &#8220;tenant in common&#8221; owns a specific percentage of the property that does not have to be equal. When a tenant in common dies, his/her share passes directly to his/her beneficiaries, who will then become new tenants in common with the surviving tenants in common.</li>
<li>Joint Tenancy with Rights of Survivorship (JTWROS) – this refers to owning an equal share of the property with one or more other persons. When you die, your ownership share in the property automatically passes to the other surviving owner(s).</li>
<li>Tenancy by the Entirety – co-ownership available only to a husband and wife, each owning one-half. In some states, only real estate can be held in tenancy by the entirety. Spouse cannot sell/mortgage property owned without the other&#8217;s approval. When one spouse dies, the other spouse automatically receives full title.</li>
<li>Community Property – this type of joint ownership can only exist between a husband and wife. Each spouse&#8217;s ownership rights are set by specific state laws and rules apply.</li>
</ol>
<p>These common forms of property ownership can at least give you a heads up in making a decision and hopefully reduce or eliminate any possible headaches. As with anything involving legalities, always consult with a competent attorney.</p>

<p><strong>Agency</strong><br />
Agencies that supervise probation have a command structure similar to that of the military. An agency is usually headed by a Director or Chief Probation Officer. Moving down the chain-of-command, there will be an Assistant Director or Deputy Chief. From there, a Senior Probation Officer or Supervisor will work with individual line officers. Parole officers can supervise general caseloads or they can specialize in one particular area of offenders, such as GPS monitoring, mental health issues and sex offenders.</p>
<p><strong>Probation Officer</strong><br />
A probation officer will perform various functions assigned by the court. Those functions usually involve supervision and research the offender’s criminal and personal history, prior to sentencing. Parole and probation officers must possess a broad knowledge of legal issues as well as possess excellent communication skills – both oral and written. In addition to understanding the various aspects and roles involved in their particular jurisdiction, they must understand the social relationships of the community. The citizens in the parole officer’s jurisdiction may be extremely diverse and there may be additional potential hazards when associating with an element of the criminal population.</p>
<p><strong>Surveillance Officer</strong><br />
In some localities, probation departments may have a specialized position known as a surveillance officer. This position affords all the authority of a probation officer and they can sometimes have the responsibilities of peace officers. This will entail attending a police academy, serving arrest warrants and carrying concealed weapons.</p>

There are practically as many types of medical malpractice as there are fields of expertise in medicine, of which there are dozens, if not hundreds. However, most cases of medical malpractice fall under one of six categories: emergency room errors, misdiagnosis, prescription errors, birth injuries, surgical errors, and general neglect.</p>
<p><strong>Emergency room errors</strong><br />
Because of its fast pace and high-stress environment, the emergency room is the most common site of medical errors. While some safety measures are standard, some hospitals fail to comply due to budget, staffing, or organization problems. Common emergency room errors include delayed treatment, insufficient first aid, and poor sanitation.</p>
<p><strong>Misdiagnosis</strong><br />
This term can refer to a wrong, delayed, or missed diagnosis, which results in a delay or complete lack of treatment that aggravates the patient’s condition. Effects can range from pain and discomfort to long-term injuries or death. Commonly misdiagnosed conditions include cancer, meningitis, heart attacks, stroke, and brain injury.</p>
<p><strong>Prescription errors</strong><br />
In this type of malpractice, the fault can be attributed to the prescribing doctor, administering nurse, pharmacy, or pharmaceutical company involved. Errors in the birthing process can cause long-term disability or death for the mother or child, or sometimes both. These include improper monitoring of vital statistics, inadequate care, and inappropriate medications. Such errors can lead to brain injuries, fractures, cerebral palsy, infection, or stillbirth.</p>
<p><strong>General neglect</strong><br />
A study by the House of Representatives showed that around 30% of nursing homes in the U.S. have had incidents of patient abuse, which cause hundreds of otherwise preventable deaths. Most cases of nursing home neglect involve failure to provide proper medication, appropriate diets, adequate supervision, and protection from safety hazards.</p>

It could have been a poorly maintained truck. It might even be a load that is excessive or unbalanced. These are just some of the factors that cause trucking accidents. While they may seem like these are the fault of the driver and his trucking company, many can actually be traced back to the trucking industry itself.</p>
<p>One factor involves inadequate training. All drivers do no receive the same level or quality of training. There are many reputable and accredited truck driving schools who strive to graduate safe and responsible professional truck drivers. Unfortunately, there are too many training schools who only give rushed training. They teach just enough to get the driver through a licensing exam. They fail to teach good driving technique and road safety concerns. They don’t teach the student driver good defensive driving skills. There are too many truck accidents that might have been avoided if the driver had received quality training.</p>
<p>A second way that the trucking industry causes accidents is their system of compensation. Many trucking companies have pay schedules that encourage speeding because they pay more if the truck reaches the destination sooner. This makes drivers speed on their routes hoping to make the extra money. Truck speeding can cause many different kinds of accidents including rollovers and jackknives.</p>
<p>These compensation plans that are based on delivery time may also tempt the truck driver to avoid sleep. They may figure that it is worth more to stay on the road a few more hours than pull over to sleep. They make take prescription or non-prescription stimulant drugs to help keep them awake. These drugs can affect their decision making capabilities and may slow their reaction times. They can also wear off suddenly, making the driver very drowsy and in danger of falling asleep while driving.</p>
<p>Another factor that is related is the expectations of the trucking industry. Many have schedules that are almost impossible to meet. They do not take into account factors such as inclement weather or road conditions. They work out schedules that they expect the truck drivers to meet. These unrealistic expectations put a burden on the drivers, forcing them to drive faster to meet the deadlines. They speed down the highways disregarding any risks that could cause an accident.</p>
<p>When a truck accident occurs often the initial blame is put on the truck driver. It is true that they will carry some responsibility. They drove too fast and too reckless. They failed to keep their truck properly maintained. They did not do the safety checks that are required before and during trips, including making sure tires are properly inflated and brakes are in good order. But while they have some responsibility, there are practices of the trucking industry and its companies that can contribute to many of the accidents involving commercial trucks.</p>
