Driving under the influence, or DUI and driving while intoxicated, or DWI, will likely be a serious issue when your driving and criminal records are checked. DUI/DWI arrests can remain in your records permanently.

All details provided for reference purposes only, contact an experienced attorney regarding the TX DWI Laws to learn more.

This can affect your employment, as employers perform background checks on prospective employees, so you want to keep your records private. You are in luck if the employer for example checks only your driving records for the past three years, when in fact, you have been charged five years ago. Nevertheless, the DUI/DWI will still appear when the employer performs a background check on your criminal records.

DUI/DWI records can be expunged from your criminal records. It is a very expensive and time-consuming procedure, but it is possible to limit your criminal records to the public. Expungement petitions can be denied if there are conditions that are not met; for example, petitioner is in probation, sentenced to state prison, or has pending criminal charges. In addition, the initial judge’s ruling should have been successfully completed, including paying fines and penalties and serving jail time.

Normally, people who request for expungement of DUI/DWI records will need to hire a lawyer who specializes in DUI and/or expungement; a lawyer who specializes in expungement is an expert in the legal procedures for expunging the criminal records. As previously mentioned, this is not an easy process, but if executed correctly (and a lot of persistence), the DUI charges can be taken off the record.

Of course, it is best to avoid DUI arrests – avoid drunk driving. Nevertheless, if you are arrested for DUI, it is of your best interest to be aware of your rights and the options that are available to you; expungement is one of your options. There are also instances when a person arrested for DUI is not guilty. By being aware of your legal rights and the options available to you will give you a fresh start.

Drunk drivers are one of the leading causes of premature death in the United States. This is one of the hardest problems for society to resolve. The culprits aren’t hardened criminals, but our nation’s sons, daughters, wives and husbands. While drunken driving rates have declined in recent years, it’s clear that drunk drivers are still a problem.

In California, a staggering 863 out of every 100,000 licensed drivers were arrested for DUI in 2007, according to the California Department of Motor Vehicles. This adds up to almost 200,000 DUI arrests annually in the Golden State alone. Even as DUI punishments stiffen, law enforcement continues making arrests, like clockwork, one Saturday night after another.

Everyone loses when dealing with drunk drivers, not just the drivers themselves. According to a report by the Loyola University Health System, drunk drivers cost society approximately 46 billion dollars annually. The money is lost mainly through decreased productivity and medical costs. The report also indicated that 22% of all crash victims were injured in alcohol-related accidents.

From a legal standpoint, DUI is one of the more complex types of cases. This is because many states have enacted “mandatory minimums” for the crime, even for first offenders. Additionally, DUI punishments can vary depending upon prior convictions and blood alcohol content (BAC).

Depending on whether or not a drunk driver’s BAC was above or below .15, offenders can count on spending one to two days in jail in the state of Washington. This is defined as either 24 or 48 consecutive hours. If an individual were arrested with a BAC of .16 and posted bail 45 hours later, he would serve an additional 48 hours when convicted.

Aside from mandatory incarceration, people convicted of DUI will also face license suspensions, fines, ignition interlock systems, high-risk insurance and restitution. If the driver caused property damage, injury or death, he could also be charged with an array of other serious crimes, such as reckless driving, criminal negligence or vehicular manslaughter.

Unfortunately for those arrested, DUI is quite often an ironclad case for the prosecution. When police pull over a citizen and suspect he is intoxicated, they’ll attempt to administer a BAC test. Since every citizen with a driver’s license has signed an agreement to this, they are obligated to consent to the test. If they don’t, the Department of Motor Vehicles is notified and the individual’s license is suspended, usually for one year. While a BAC test is incredibly helpful for prosecutors, they don’t always need it; when the test is refused the police usually obtain a court order for a blood test.

Whether someone facing charges for drunk driving has a good case or not, he should know that an experienced attorney can greatly impact the case’s outcome. Although DUI carries mandatory minimums, there’s nothing to stop a judge from exceeding them. An attorney will stand in a defendant’s corner and fight, either to get him acquitted or to help him to obtain the lightest sentence possible.

Drunk drivers cost productivity and lives. The problem is huge, comprising hundreds of thousands of arrests each year. DUI cases are quite serious, offering fairly stiff punishments that differ from case to case. Whether innocent or guilty, accused or red-handed, anyone charged with drunk driving should hire legal representation. This will help bring about a quick resolution that’s as favorable as possible.

Learning that one’s newborn child has sustained an infant hematoma may well be distressing news, though the prognosis can be good if detected early enough.

What is infant hematoma?

An infant hematoma , is also known as subdural infant hematoma, and simply means that the veins beneath the outer covering of the brain have torn, thus allowing blood to pool and necessitating speedy diagnosis and quick intervention in order to prevent permanent damage.

Causes

The cause of an infant hematoma is often due to trauma, or injury to the head. Whether inflicted intentionally as an instance of child abuse; accidentally; or for a cause that cannot be ascertained, it is frequently the subject of investigation. A study published in 2000 in “Pediatrics,” the journal of the American Academy of Pediatrics, found that almost 20 percent of infant hematoma resulted from accidental trauma. However, 76 percent of cases were found to have resulted from abuse. The younger the children were, the more likely that abuse was the contributing factor.

There is the further possibility that the trauma could have been inflicted during the birth process. Despite the sophistication of modern medical procedures, unexpected circumstances can arise and errors can be made. Such difficulties can occur when the baby is not passing through the birth canal in a normal manner and human intervention becomes necessary. This often requires physicians to use specific tools to adjust an infant’s birth journey. Infants who have turned sideways, for example, might have to be turned around. Such difficult deliveries frequently involve the use of forceps, or vacuum extraction devices.

Symptoms

There are tell-tale signs of infant hematoma. According to the National Institute of Health, these include a bulging fontanelle, the soft spot on a baby’s skull that hardens with time. Perfectly normal fontanelles can bulge, however, tending to enlarge somewhat when in a prone position. If the size of the fontanelle reverts to normal after sitting up, no problem is indicated. Feeding difficulties, seizures and persistent vomiting are also signs to look for. Additional indicators are enlarged head circumference, a high-pitched cry, and excessive sleepiness or irritability.

Certain individuals can be classified as disabled and receive benefits from the government. For example, an adult who is disabled may be able to receive income from social security. Social security is government sponsored insurance that is available to people who meet specific criteria in regards to age, disability, poverty, and unemployment.

However, you may be wondering if children can receive disability benefits from social security. The answer to that question can be tricky. For example, an adult may be able to receive social security for disability if he or she can prove that the disability prevents him or her from performing the labor that would be necessary to find gainful employment where that person lives. Children, however, don’t usually work. In a lot of case, they can’t even be legally employed. So this may leave some confusion over what kind of criteria would be used in a case involving a disabled child.

This is answered by the fact that cases over children’s disability claims have been won when it was proven in that case that the child was not able to function normally when attempting to perform activities that are relevant to children of that age.

Of course, one of the most important of these activities is school. If it can be proven that the child cannot function in a regular classroom, this benchmark for receiving disability benefits may be met.

Evidence supporting this fact will have to be gathered to make the case for how debilitating the child’s disability is in regards to school performance. A disability lawyer will probably want to track down things like report cards, records of the student’s involvement in individualized education programs, intelligence quotient tests, and achievement tests. Also likely to be needed are surveys and interviews with the student’s teachers. These are likely to give good insight into the child’s situation.

Unfortunately, obtaining these kinds of records and information isn’t exactly easy. This is likely to make a child’s disability claims case more difficult than a case involving an adult. There is also the possibility that childhood disabilities can be grown out of. One common example is asthma.

However, despite these difficulties, many such cases have been won. If you have a child who you think deserves disability benefits, you should contact an attorney who specializes in disability law.

A hit and run boils down to one essential element: an individual failed to identify himself and fleed the scene of a crime, either after damaging another person’s property or after harming another person. Usually, hit and run crimes involve automobiles. In some cases, the perpetrator might hit someone, perhaps a pedestrian, with their car and drive away without helping the person, calling for help, or identifying himself. In other cases, the perpetrator might hit another individual’s car and drive away. Leaving the scene of a crime is treated as a very serious offense.

Hit and Run Crimes

A hit and run violation only worsens the sentence a perpetrator is given for committing a crime. In many jurisdictions, drivers are obligated to identify themselves and exchange pertinent information, including insurance details, when they get into an automobile accident with another driver or with a pedestrian. Usually, state laws require the driver to pull over as soon as they can do so safely. If an individual hits another car, many states require drivers to leave a note with their contact details or to make some other effort to contact the individual who owns the car or property.

Felony Hit and Run
When an individual flees the scene of a crime where an individual is either injured or killed, the individual is charged with felony hit and run. If there is no harm to a person, the individual will be charged with misdemeanor hit and run. Felonies are very serious crimes, and convicted felons must make life-long changes even after serving their prison sentences. For example, felons lose the right to bear arms and the right to vote for the rest of their lives. Therefore, felony hit and run crimes are very severe and are not to be taken lightly. Those convicted of committing misdemeanor hit and run usually are not sentenced to jail time, but they do pay hefty monetary fines.

Further still, Maryland was the first US state to pass the workers’ compensation law in 1902. It is in 1906 that the first law protecting federal employees was passed. In 1949, all states had endorsed different forms of the workers’ compensation laws. In the past, these schemes were generally referred to as workman’s compensation but this has since changed to workers’ compensation so as to make it sound neutral as pertains to gender.

Work Injuries and Medical Care

Therefore, quite a number of employees who sustain injuries at their work place have the right to claim medical care. In many cases, employees are given monetary payments for temporary and permanent injuries that result from injuries sustained at work. However, it is recommended that employers should enroll for workers’ compensation failure of which one may get penalties. Several states have public uninsured employer funds which enable employees working for companies that do not purchase insurance to get benefits. What is more, there are quite a number of insurance policies that employers can choose from through commercial insurance companies. Still, employers can also get insurance coverage from an assigned-risk program in cases when the company is believed to be of a great risk such that it can not be insured at a market rates.

Every state has its own way of overseeing workers’ compensation. Furthermore, every state also has a governing board that oversees the various public and private grouping of the systems of workers’ compensation. The federal government on the other hand also has it own program for workers’ compensation. This is governed by the federal requirement as well as statutory factor in relation to federal employees. However, workers’ compensation in most states is usually provided by private insurance companies. About 12 states have insurers operating on the state fund while quite a few are owned by the state as monopolies. Private insurers are usually protected from overcrowding by state funded insurers. Thus, state funded insurers are normally required to act as assigned-risk programs. The California’s state Compensation Insurance fund is considered the largest insurer.

Termination of Injured Employee

In several states it is unlawful to terminate an employee or to deny an individual employment because he/she has reported an injury sustained at work. The challenging issue is that proving discrimination using an employee’s claims history may be quite difficult. It is for this reason that most states have come up with subsequent injury trust funds that pay insurers for the benefits that they pay to workers who have suffered a compensable injury that this recurrent. Recommendation has been made to remove claims history in database or to make them anonymous.

Even though it is not common for employees to claim for false benefits, there are instances when recorded videos show an employee carrying out a strenuous physical activity or sport even though the employee may have claimed that he/she suffered an injury or disability. Such videos by private investigators are however not allowed in trial especially if they recording violated the employee’s privacy.

On the other hand, other employees aggressively contest for payment under the workers’ compensation. Such cases, especially ones entailing severe injury require counsel of an experienced lawyer conversant with workers’ compensation claims. However, many states have enacted laws that hinder the claimant from spending a certain amount of money for legal purposes.

Several states have however transferred disputes of workers’ compensation from the trial courts and taken them to special administrative agencies. Further still, organizations such as ABA, IAIBC and NAWCJ are striving to educate and guide workers’ compensation administrators and adjudicators.

You send your child off to school every day and assume that they will be safe there. More often than not this is the case, but accidents can and do occur in schools. Most of them are every day occurrences that kids will encounter whether they were in school or not. Occasionally they can be more unusual.

In most developed countries in the world, schools are under strict codes to provide a safe environment for children and staff. Personal injury rules will vary from state to state and country to country, but the basics tend to be the same. For your own area you would need to research the finer details if you ever needed to make a personal injury claim.

There has been rising concern about the costs some schools have had to pay out in personal injury claims in the UK over recent years. Many of these have been by staff claiming compensation for tripping on food, wet floors and injury caused by furniture. Funding for schools is often difficult and much of the concern is that money being paid out in court costs should or could be being used to improve the school in other ways.

For the majority of people though, school safety is about kids. Schools are required to provide adequate protection in terms of:

Safety approved playground equipment. Accidents will still occur on even the safest of playgrounds but good ground and well designed equipment has meant a decrease in many major injuries occurring.

Adequate fencing needs to be provided around any maintenance or construction work within the school area.

Any playground hazards are expected to be noted and dealt with. Things like broken glass need to be cleared away immediately and fencing put around any potential hazards that cannot be dealt with straight away.

Strict rules to abide by concerning trips away from school, including identifying potential hazards. If a parent is at all concerned with these guidelines they can contact the school or refuse permission.

In some areas there is sometimes a fine line between where the school’s responsibility for students ends and where parent responsibility takes over. School crossings and children’s safety before and after school can become personal injury issues.

Many personal injuries can occur to children through things like doors slamming or being shut on fingers, slipping on wet floors or equipment left out such as guillotines for paper cutting. Some of these are obviously the schools responsibility and some are beyond their control.

If your child is injured at school, or coming to or from school you should seek legal advice. It is a good idea to always read the schools policies too and be aware of what the requirements are in your local area. In most states and countries schools are obliged to have written statements regarding all areas of safety and have personal injury reduction guidelines in place.

Schools are there to provide the best education they possibly can and to ensure that the children in their care are as safe from personal injury as possible. Ideally parents and schools will be working together for the children.

Most people will never set foot in a courtroom as a result of the distribution of someone’s estate. As such, the term “probate litigation” is likely foreign to most people in our society. In fact, the term “probate” itself may be unfamiliar to many.

What is Probate?

Probate is when someone dies and their estate is distributed through the probate court system. People can die leaving their estates in several ways. A person can die with a will, known as dying testate. When a person has a will, the will is entered into probate with the probate court, which is a special court through which the provisions of the will are carried out, including distribution of assets as set forth in the will. When a person dies without a will, he dies intestate. The probate court then appoints an administrator of the estate and the assets of the deceased are distributed through intestate succession. Intestate succession means that those related by blood to the person (along with the spouse, if there is one) will inherit the assets of the estate. Certain assets, such as life insurance proceeds or trust assets, are not entered into or are a part of probate proceedings.

What is Probate Litigation?

Typically, when assets are distributed via either a will or intestate succession, the parties are agreeable with the terms and do not dispute it. However, sometimes an heir or someone who feels they should have received an inheritance will dispute the will provisions or even some aspect of inheritance through intestate succession. When that happens, probate litigation results. Probate litigation takes place when such a dispute arises resulting in a claim made to the probate court and the issue is resolved through the court system.

The most common situation where probate litigation arises is when a child or other close relative has been left out of one’s will. That person will likely argue that it was either the result of a mistake, or undue influence on the part of someone else, such as the widow or other children of the deceased. Undue influence means that someone had some sort of control over the testator and caused the testator to change his or her will in favor of that person. Other times there may be a claim that a different, more favorable will exists that is the valid will, or a claim that the will entered into probate is not valid.

Most attorneys agree that representing drug dealers is one of the most lucrative deals one can clinch as an attorney. This is not without risks as most big time drug dealers can turn the tables once they feel their interests are not being adequately catered for. The international drug trade is an elaborate enterprise that consists of several stages. These include tending the primary producers which are mainly plants, value addition, distribution and finally sale on the streets.

What Makes Drugs Illegal
It is important to note that most substances classified as drugs are not entirely illegal. As a matter of fact, they contribute to the national economy under license. They are intended for use under controlled conditions e.g. surgery or for pain alleviation. Drug operations have very discreet methods of conducting business. Not even attorneys representing them have full insight to the whole organization. Cartels are usually in charge of the various stages of the distribution network. The structure and size of these cartels depend to a large extent on the particular mandate it is charged with. They include the street peddlers, middle men and the dons or patriarchs who usually head a drug trading family that might control a drug bourse running into billions of dollars. According to a U.N report, the international drug trade represents 0.9% of the entire global commerce.

Drugs are grown in the most discreet of places. The farms might be indoors, on top of buildings or in protected areas e.g. national parks. Value addition or processing is also a top secret affair mainly taking place in heavily fortified or isolated buildings. The global market for narcotics is vast and in most instances ready to pay any amount for a constant supply of the same. This means that irrespective of the big amounts of money involved in concealing narcotics from law enforcers, once they get into the target market, they still rake in obscene profits.

Attorneys are quick to point out that not all drugs trade classified as illegal involves narcotics. Legal drugs e.g. cigarettes and alcohol that have not had duty paid for them are also part of this clandestine trade. These are very hard to unearth as they normally follow a legal route in the initial stages before diversion. The prescription model in most countries acts as a kind of restriction to the proliferation of various drugs.

The War against Drug Usage
The war against narcotics is a very complicated affair considering that demand for these narcotics is not showing signs of reducing anytime soon. Any attorney will bear testimony to the fact that the justice system in narcotics producing countries is extremely flawed and heavily infiltrated by agents who are on the drug lords’ payroll.

Owning a property does not come easy. There are so many steps and legalities involved and some people don’t know where to begin. Before anything else, you can start off by doing some research to help you understand the basics of owning a property. Here is a quick overview:

What is Property Ownership?

Once a person or a group of people own a property, they have the right to sell, rent, consume, mortgage, transfer, exchange, and destroy this property at their own discretion.

What are the Forms of Property Ownership?

Here are some common ways of owning a property:

Sole Property Ownership – this refers to a property owned entirely by one person without any other owners. When you die, property owned in your name can be distributed to your beneficiaries in your will, as long as you recognize your spouse’s marital interest.

Tenancy in Common (TIC or T/C) – this refers to a property owned by two or more persons at the same time. Each person “tenant in common” owns a specific percentage of the property that does not have to be equal. When a tenant in common dies, his/her share passes directly to his/her beneficiaries, who will then become new tenants in common with the surviving tenants in common.

Joint Tenancy with Rights of Survivorship (JTWROS) – this refers to owning an equal share of the property with one or more other persons. When you die, your ownership share in the property automatically passes to the other surviving owner(s).

Tenancy by the Entirety – co-ownership available only to a husband and wife, each owning one-half. In some states, only real estate can be held in tenancy by the entirety. Spouse cannot sell/mortgage property owned without the other’s approval. When one spouse dies, the other spouse automatically receives full title.

Community Property – this type of joint ownership can only exist between a husband and wife. Each spouse’s ownership rights are set by specific state laws and rules apply.

These common forms of property ownership can at least give you a heads up in making a decision and hopefully reduce or eliminate any possible headaches. As with anything involving legalities, always consult with a competent attorney.
